A 5-hectare plot sold as a whole is worth one thing. Sold as 10 parcels of 5,000 m², it can be worth 2 to 4 times as much. That is the logic behind land subdivision—but it only works if it is done in accordance with the law. The law governing this is Decree-Law 3,516 on the subdivision of rural properties.
The golden rule: 5,000 m²
Decree-Law 3,516 allows for the free subdivision of rural property (agricultural, livestock, or forestry) provided that the resulting lots have an area of no less than 0.5 hectares (5,000 m²). That is why almost all plots in the south measure exactly that: it is the legal minimum.
The Step-by-Step Process
- 1. Title review: The property must have registered title and be free of any issues. If there are inheritance or ownership disputes, they must be resolved first.
- 2. Topographic survey and subdivision plan: boundaries, access roads, and right-of-way easements for interior lots.
- 3. SAG (Agricultural and Livestock Service) certification: The SAG (Agricultural and Livestock Service) certifies that the subdivision complies with Decree-Law 3,516.
- 4. Registration: Each lot is registered with the Registrar of Deeds and assigned its own property tax ID (rol) by the SII.
Mistakes That Can Be Costly
- Selling “rights” before certification: Buyers are left without title, and the entire project may fall through.
- Lots without access: An interior lot without a registered right of way is unsellable.
- Promising infrastructure that doesn’t exist: The law prohibits irregular subdivisions with hidden infrastructure projects; the fines are severe.
- Ignoring the rural zoning designation: These parcels are designated for agricultural use; building a home is possible, but only under the rules of Article 55 of the LGUC.
How long does it take, and how much does it cost?
With clear title, a complete subdivision (survey, plans, SAG approval, and registrations) typically takes 6 to 12 months. The cost depends on the number of lots and the complexity of the land—and is more than recouped through the increased sale value.
